摘要： 对共同侵权行为本质的认识主要有主观说、客观说、折衷说三种，其中以折衷说更为合理，这样的判定标准能够实现行为人行为自由与受害人利益保护之间的利益平衡。共同侵权行为的判定标准决定了其民事责任承担方式的适用范围，而一个合理的判定标准能够为其连带的民事责任承担提供合理性基础，实现连带责任的积极价值。但是，对于共同侵权行为适用连带责任的传统理论，目前在理论界出现了质疑之声，域外的司法实践也反映出共同侵权行为的民事责任向分割责任发展的趋势。对我国而言，坚持共同侵权行为适用连带责任的立场，既符合加强对受害人救济的侵权法发展趋势，又有利于受害人通过诉讼获得救济，同时符合我国社会现实情况的需要。

Abstract： There are three standpoints about the essential of joint tort including the subjective joint theory, objective joint theory and compromise joint theory. The third one seems to be more rational. The compromise joint theory can balance the benefit between the behavior freedom and victims' protection. Criterions for joint tort decide applicable scope of its civil liability. A reasonable criterion can provide a rational base for its joint liability and realize the positive values of it. But there are opposition opinions in theory what direct towards the traditional view that apply joint liability to joint tort. The foreign judicial practices also reflect the trend that civil liability of joint tort is developing to be separate liability. For our county, persisting the position of joint liability is up to the development trend of tort law that is strengthening protection for victims, is propitious to assist victims with getting compensation through lawsuits, and is also more in line with the need of our society reality.
